
America’s highest court of nine justices will probably see two vacancies in the next four years due to retiring judges.
The Supreme Court figures prominently in American life because many issues are often left unresolved until the Supreme Court rules on them.
Although Obama will be most likely replacing two liberal justice, he could still move the Court more to the left.
Obama favors two things in a justice that should give us reason to worry. First Obama does not believe in blind justice, but, rather, that the merits of the case should be balanced against the circumstances of “victims” such as Blacks and gays. Such a view would be an incredible departure from American’s legal heritage and embrace a radical New-Age concept of justice that is anything but Someone’s race, sex, religion, and sexual orientation should not be the determinant as to whether they have the law on their side.
Second, a early tape of Obama was released a few days before the election where Obama is discussing the Supreme Court and laments that the Court has not in the past dealt with issues of redistribution of wealth. Although Obama added that the Court is probably not best suited to such a discuss, he does embrace a legal scholarship that would find “rights” in the Constitution to such matters as welfare and other entitlements. Instead of legislature dealing with such issues, a President Obama (if his past words are anything to go by) would outsource such matters to judicial activists.
Obama endorses the concept of a “living Constitution”. This is the radical left-wing view that America’s Constitution is “living” therefore its meaning can be changed at any moment in accordance with the ideological views of the justice. If Obama wants the Constitution to be changed in meaning he could do what’s honest and amend it, but instead he would allow justices to act as legislatures and decide for themselves what the most important document in the nation says.
Obama has voted against such qualified and intelligent justices as the nation’s current Chief Justice of the Supreme Court, C. Justice Roberts. To Obama, a man like Roberts is unworthy due not to his lack of qualifications but his ideology.
For those who believe in freedom and liberty, in the American Constitution, and in justices upholding the law not writing it; the idea of a President Obama making appointments is rather scary.
